EPA Back to Drawing Board for Renewable Fuel Rule Exemptions (1)

The Environmental Protection Agency’s decision rejecting small refineries’ exemption requests from renewable fuel obligations was vacated by the D.C. Circuit in a sealed opinion.

The court on July 26 granted most of the petitions for review in the consolidated cases filed by Sinclair Wyoming Refining Co., vacated the denial order, and remanded to the EPA. The reasons for the court’s ruling remain under seal pending the parties showing cause by Aug. 5 as to why it should be unsealed.
